Further to What the Hell is Going on Your Honour, Stupid Magistrate, An Eastern Suburb Court Room and Faruque's Victory please examine the followings should you wish.

Yesterday, I went to assist Mr. "Khomeini" who is a member of ours. The member is question is a nice and trustworthy person. Because of his national origin he should not have to be considered or found guilty of anything. Yet, it appeared to me that he is a victim of such a scenario!

Initially I wrote a "statement of fact" for him. Upon receipt of that document the `loaded' Police ganged up against him and she found two more colleagues to add more lies against the driver. For an example, the female Police Officer said, "I handed over the infringement notice to the driver" and her friends said, "I saw/noticed her to hand over the Infringement notice to the driver" etc. etc. However, we have an envelope with handwritten address, appropriate stamp and date as well as an undated infringement notice to prove our case. The case is a bit complicated and it has a few twists. The Police/prosecution supposed to handover the briefing papers in due course. Yet, they do it at the last moment i.e. a few minutes before the hearing, to take advantage.

I appeared in front of an experienced and happened to be a decent lady judge. As I opened my case and found the prosecuting Sergeant is not a bad person. However, I noticed some interference from my back! I realised, an energetic young person happened to be a lawyer of Egyptian heritage requested me to be a party to this case on a pro bono basis. After a bit of laughter and procedural drama we adjourned the case for a while and added him in our camp. Many young lawyers of his situation do pro bono work like this for a number of reasons.

During my conversation I found him smart and capable. Because of the prospect and excitement of the case he got a bit excited and in one stage, with his honesty he asked the police to drop the case with a bit of hint to them. I don't do this. Because I love to kill it dead, entirely! Now, the red face police camp got worried and possibly looking for a hand shake. Anyway, we left the matter for the final hearing at a later date for the fun of it.

We went out side the court room and noticed some one dressed like Bin Laden and he got a beard like Bin Laden too. I approached him and said, "can I help you". His response was, "Faruque bhi …. ". I said, "you know me and saw me but did not ask for any assistance!" His reply was, "I saw you earlier but I thought your may be busy with some serious issues". My response was, "don't be silly we will fight and survive together, come on".

The case was, he is an educated and religious person, happens to be driving taxis some time. He picked up a female from Oxford Street, Darlinghurst going to Rushcutters Bay. On the way, the passenger asked him to make in illegal right hand turn from Oxford Street to Crown Street. The driver politely declined to do so and instead he made a left at Crown and then made a safe U turn to continue his journey. The stupid woman passenger asked him to drive faster. He again politely declined and explained the reason for his action. Now, he is turning right at William Street and then she said, you have to wait at the Vive Hotel and then I will continue to Edgecliff. The driver said, "no problem but you have to pay some deposit". She was silent. However, as they approached at the hotel and the car was slowing down only and not stopped entirely, the passenger opened the door without saying anything! The driver said, "what's going on". Her reply was, "I am going to the hotel". The drivers said, "you pay some deposit first and then you can go". Although, there are a few more twist and turns within this story. The net impact was she initiated arguments, caused problems, started violence, did not pay the driver his lawful earnings. Yet, a female who happened to be on that spot at that time went on against our "Bin Laden" for reason(s) unknown to me. The poor driver was not in their level! He just defended himself and then left the place at the earliest opportunity. Now, he is up for assault and reckless driving!!

At that stage, so called two witness and police gave their prejudicial statements to the court and the poor driver who was unrepresented did not know the court procedures. As a result he was unable to cross examine them and thus in a way he was up for mockery of justice.

I appeared in front of the judge and asked his permission to represent the driver. He rudely denied me the permission and the prosecuting sergeant placed his objection. The Egyptian origin lawyer was with me too and he left the room with anger. As a lawyer, his behaviour inside a court room is restricted. However, I am not under many restrictions. So, I sat on the bar table and made attempts to assist him in a different manner.

In that proceedings, I observed, they made serious attempts to short change our "Bin laden" and the judge in question have no respect for "notions of justice" or "fairness".

At one stage I lost my cool and forwarded a document to the judge via prosecution which says, "However, existing prejudices are evidenced in the the Keatsdale Report (NSW Department of Transport and Work Cover Authority} and The Dalziel Report (Sydney Uni, Dept. of Psychology, Vol. 1 and 2) and I have also been told by many of my workmates that prejudice towards non Anglo taxi drivers, specifically those of Middle Eastern background and appearance has increased lately".

I could see the anger in his face then and during the trial he never looked at me. Yet, I reminded him about the notion of justice and fairness in a way, I estimate he deserves!

Finally, even with his loose standard, `his honour' found the female passenger:

1. was the initial troublemaker,

2. initiated the trouble,

3. initiated the violence,

4. failed to pay the fare and

5. the prosecution failed to prove that the driver was involved in violence! Therefore, the driver is not guilty for an assault.

Yet, he found the driver `guilty of reckless driving"!

You see, if the judge would have allowed me to represent him or if he would have some assistance, he could have won the case easily.

For an example, as a taxi driver in this town, if you are in a trouble or facing drunken or ill-motivated trouble makers, who happened to left your doors open; you don't follow the bloody non existing Occupational Health and Safety Act and other stupid acts and then get out of your taxi (to get belted) while your ignition key is at your palm, then close the door(s), smile at everyone (to get more bashings) and then thank them for beating you up. In fact what you do is, make instant decisions to save your and others life, minimise the aggression, try to keep the situation under control as much as possible. When opportunity permits, kick the accelerator with a reasonable safety, press the brake to shut any door(s) remained open then (do not stop the car or remove the ignition key and if you can keep the drivers side window up and door locked) and then make a suitable decision based on reality and they could not be found in a text book or described from here.

However, the prejudicial judge found him guilty of negligent driving with the assistance of the opportunist prosecutor, "because he drove the taxi while the door was open"! Thus in a way our honest and decent "Bin Laden" was fined 357.00 for reckless driving. I made my anger a bit visible then. I also realised, the earlier mentioning of three reports made him weary and he refrained from delivering a full guilty verdict.

The driver in question said to me, "Faruque bhi, thanks for trying. I know and all of my friends told me, the system will find me guilty and I was prepared to throw my licence at his face". I said to him, "your statement is not just emotional, it got some merits too. But, in future, share them with your friends and try to survive together.
